If you paid for one or more prescription drugs with insurance at Kroger, a class action settlement could affect you. All individuals in the United States and its territories who, at any point in time from December 9, 2018 through August 23, 2026, paid in whole or in part for one or more prescription drugs from Kroger using their insurance may be eligible to receive a payment from this class action settlement.

A federal court authorized this notice. This is not a solicitation from a lawyer.

COLUMBUS, Ohio, Aug. 24, 2026 /PRNewswire/ — A proposed Settlement has been reached in a class action lawsuit against The Kroger Co. (“Kroger”) on behalf of individuals who paid for one or more prescription drugs from Kroger using their insurance. The class action lawsuit, Kirkbride et al. v. The Kroger Co., No. 2:21-cv-00022 (S.D. Ohio), relates to whether Kroger should have considered the prices it charged under its Rx Savings Club or Health Savings Club (“Savings Club”) when determining its usual and customary (“U&C”) prices it submitted when submitting insurance claims for customers. Plaintiffs allege that Kroger should have considered its Savings Club prices when determining its U&C prices. Kroger denies any wrongdoing and maintains that it correctly reported its retail prices as its U&C prices. The Court has not decided who is right.

What Does the Settlement Provide?
The Settlement provides the following monetary relief to Settlement Class Members who submit a valid and timely Claim Form:  

  • Kroger will pay $17,000,000 into a Settlement Fund to settle all claims in the lawsuit brought on behalf of Settlement Class Members.
  • The Net Settlement Fund will be distributed to Settlement Class Members who file valid Claim Forms. Payments will be calculated based on the amount a claimant paid, in whole or in part, during the Settlement Class Period, for the purchase of one or more prescription drugs from Kroger, where prescription insurance benefits were used in filling the prescription(s).
  • Settlement Class Members can receive a cash payment by submitting a valid Claim Form and, in certain circumstances, submitting supporting documentation.

Am I eligible to receive a payment from the Settlement?

You may be eligible to receive payment if you are an individual who, while living in the United States or its territories, paid in whole or in part for one or more prescription drugs from Kroger using your insurance from December 9, 2018 through August 23, 2026 (“Settlement Class Period”).

How do I get a payment from the Settlement?  

You must complete and submit a Claim Form on or before December 21, 2026.

  • You can submit a Claim Form online at www.krogersavingsclubsettlement.com on or before December 21, 2026; or
  • You can mail a paper Claim Form postmarked on or before December 21, 2026. To request a paper form, call 1-888-535-4262 or email info@krogersavingsclubsettlement.com.

What are my rights?  

If you are a Settlement Class Member, you may participate in the Settlement by completing a Claim Form online or mailing a paper Claim Form as described above.  If you are a Settlement Class Member and either submit a Claim Form or do nothing, you will be bound by the Settlement and will give up any right to sue Kroger in a separate lawsuit related to the legal claims in this lawsuit. If you want to keep your right to separately sue Kroger, you must exclude yourself from the Settlement by October 22, 2026. If you do not exclude yourself, you may object to the Settlement and/or ask for permission to appear and speak at the Fairness Hearing by October 22, 2026.  Any requests for exclusion or objections received after October 22, 2026 may be deemed untimely and invalid. The Court’s hearing.  

The Court will hold a hearing on January 11, 2027, at 10 a.m. in Courtroom 1, Room 331 at the United States District Court for the Southern District of Ohio, Kinneary U.S. Courthouse, 85 Marconi Boulevard, Columbus, OH 43215 to decide whether to grant (1) final approval of the Settlement including the proposed plan of allocation and distribution, and (2) Class Counsel’s requested attorneys’ fees in the amount of one third of the Settlement Fund, reimbursement of Class Counsel’s costs and litigation expenses not to exceed $610,325.71, plus interest (if any), and (3) Service Awards to the named Plaintiffs in the amount of $5,000 each. You and/or your own lawyer may appear and request to speak at the hearing at your own expense, but there is no requirement that you do so.
