Kaneka Intends to Appeal Invalidity Decision in Lawsuit Against CoCrystal

TOKYO, Sept. 8, 2026 /PRNewswire/ — On October 5, 2023, Kaneka Corporation filed a complaint against Cocrystal Technology (Jiaxing) Co., Ltd. and Cocrystal Health Industry (Zhejiang) Co., Ltd. (collectively “CoCrystal”) in the U.S. District Court for the Eastern District of New York (1:23-cv-7483-SJB-SDE) alleging that their supplements containing reduced coenzyme Q10, also known as “ubiquinol”, infringe claims 5 and 15 of Kaneka’s U.S. Patent No. 7,829,080 (the “‘080 Patent” or “Patent”).

On September 2, 2026, the New York District Court dismissed this litigation, holding that the Patent is invalid for lack of enablement. This decision was issued despite the fact that Kaneka submitted tests showing significant utility during the Patent’s application and that a District Court in Delaware had previously held the Patent valid.

Kaneka strongly disagrees with the New York District Court’s legal decision and interpretation of the evidence supporting the Patent’s validity and significant utility. Kaneka will immediately appeal the decision to the Federal Circuit Court of Appeals.

The protection of Kaneka’s intellectual property stands as a paramount cornerstone of its business. Kaneka’s commitment to safeguarding these rights is unwavering, and it will not hesitate to take decisive legal action against anyone who fails to respect Kaneka’s intellectual property, including its ‘080 Patent and other patents pertaining to reduced coenzyme Q10. In the lawsuit against CoCrystal, Kaneka is fully prepared to, and will, vigorously enforce its patent rights to the fullest extent.
