CBP Takes Enforcement Action Against XCMG, Importer of Chinese Mobile Access Equipment, for Evading Trade Laws and Undervaluing Imports, Wiley Reports

WASHINGTON, Oct. 6, 2026 /PRNewswire/ — U.S. Customs and Border Protection (CBP) has announced a final affirmative determination of evasion against XCMG North America Corporation (XCMG), a U.S. importer of mobile access equipment. The Coalition of American Manufacturers of Mobile Access Equipment (CAMMAE), which is comprised of leading U.S. manufacturers of boom lifts, scissor lifts, telehandlers, and other mobile access equipment, submitted information last year to CBP alleging that XCMG and its affiliates were evading antidumping and countervailing duties on imports from China by falsely claiming that their imports were manufactured in their facility in Mexico. CBP initiated an investigation in response to these allegations, and its final evasion finding confirms that XCMG was evading the trade orders on imports of mobile access equipment from China.

Brightbill, co-chair of Wiley’s International Trade Practice and counsel to CAMMAE. “Vigorous enforcement of antidumping and countervailing duty orders is critical to securing the relief U.S. companies are entitled to by law. CBP’s response reflects the seriousness of importers’ efforts to evade these orders.”

During the investigation, XCMG’s entries were suspended back to July 2025. The final evasion decision imposes likely duty rates of 69.31% on those and future entries by XCMG from Mexico.

Notably, CBP’s decision was based in part on findings that XCMG was “untruthful” in some of the information it provided to the agency and that certain of the company’s production records were “highly unreliable.” CBP also found evidence that XCMG undervalued its entries of mobile access equipment to lower duty liability. CBP will publish a public version of its final determination on the agency’s website.

Antidumping and countervailing duty orders have been in place on Chinese imports of mobile access equipment since December 2021 and April 2022, respectively. Combined duty rates are substantial and can reach up to 180% for some Chinese producers and exporters. Duty evasion, absorption, and circumvention are illegal and are closely monitored by CBP, in conjunction with the U.S. Department of Commerce, and severe penalties may apply. Wiley closely monitors unfair trade practices and remains committed to robust enforcement of trade laws, including the orders covering dumped and subsidized mobile access equipment from China.
