The episode provides restaurant operators, license holders, developers, lenders, and municipal officials with an authoritative breakdown of New Jersey’s major liquor license statutory overhauls.

New Jersey recently reformed its retail alcoholic beverage licensing framework twice within less than three years. These legislative updates ended the long-standing practice of indefinite dormancy for inactive “pocket” licenses, established structured activation timelines, and opened new intermunicipal transfer mechanisms designed to drive economic redevelopment.

Key Highlights Covered in Episode 7 (Part 2):

  • Ending Indefinite 12.39 Relief (P.L. 2023, c.290): Historically under N.J.S.A. 33:1-12.39, inactive Class C license holders could repeatedly petition the Director of the Division of Alcoholic Beverage Control (ABC) for good-cause “12.39 relief” to maintain dormant licenses across consecutive terms.
  • The 2026 Reset & Revised Quartile Timetable (P.L. 2026, c.46): Enacted on July 23, 2026, P.L. 2026, c.46 superseded key portions of the 2024 law, resetting the four-group inactive license quartile schedule to run one, two, three, and four years from July 23, 2026.
  • Municipal Extensions & 30-Day ABC Appeals: Under the 2026 law, municipal issuing authorities possess expanded discretion to grant extensions beyond two consecutive inactive terms when a licensee demonstrates documented good-faith efforts to activate or transfer the license.
  • Three Distinct Intermunicipal Transfer Pathways: P.L. 2026, c.46 replaced the earlier contiguous municipality restrictions with three flexible transfer procedures to serve qualifying redevelopment, revitalization, or improvement areas[6]:
  1. Municipal Sale of a Newly Authorized License: Allows a municipality authorized to issue a new license to offer it at public sale to private bidders or to the highest bidding municipality statewide[14][15].
  2. Owner-Initiated Transfer: Permits an inactive license holder or contract purchaser to transfer a license to a qualifying redevelopment premises located in the same county or a contiguous municipality in an adjoining county[14][16].
  3. Receiving Municipality RFP: Enables a population-capped receiving municipality to solicit statewide RFPs to acquire an inactive license from the lowest qualified bidding owner for a designated redevelopment project[14].
